1. Who we are and what these terms cover

These terms of use ("Terms") govern your access to and use of GoldRateToday at goldratetoday.net.in, including its pages, rates, charts, calculators, guides, news and related data services (together, the "Site"). The Site is owned and operated by Orion Appworks ("Orion Appworks", "we", "us" or "our"). These Terms form a legal agreement between you and Orion Appworks, and they are an electronic record under the Information Technology Act, 2000, which does not need a signature.

These Terms should be read together with our privacy policy, cookie policy and disclaimer, which also apply to your use of the Site.

2. Accepting the Terms

By opening or using the Site, you confirm that you have read and agree to these Terms. If you do not agree, please do not use the Site. If you use the Site for a business or on behalf of an organisation, you confirm that you have the authority to bind it to these Terms.

3. Who may use the Site

You must be able to form a binding contract under Indian law to accept these Terms. If you are under 18, you may use the Site only with the involvement of a parent or guardian. The Site is intended for people in India, though anyone may read it.

4. What the Site provides

The Site provides general information about gold prices in India, along with tools and guides. It is an information service only. We do not sell gold or any financial product, we do not take payments or deposits, and we are not a party to any transaction between you and a jeweller, bank, lender, platform or other seller. Our disclaimer explains the limits of the information we provide, including that rates are indicative and that nothing on the Site is investment, tax or legal advice.

5. Using the Site: what you may do

We give you a limited, personal, non-exclusive, non-transferable and revocable permission to access and use the Site for your own lawful, non-commercial purposes, and to view, print or save pages for your own reference.

6. Using the Site: what you may not do

You agree not to, and not to let anyone else:

copy, scrape, harvest, mirror or systematically download our rates, history, content or data, by automated means or otherwise, or republish them in bulk, without our written permission. The only exception is the free rate widget we offer on our widget page, which you may embed as provided, with its link back to us left in place;
access, call or test any of our data endpoints, including the interfaces on api.goldpricetoday.net.in, other than through the Site as it is presented to you. These interfaces exist to operate the Site, and they are not a public service;
send automated, excessive or abusive requests, or do anything that could overload, disrupt or damage the Site or its systems;
try to bypass any security, rate-limit, access-control or bot-protection measure, or to gain unauthorised access to any part of the Site, our systems or other people's data;
introduce viruses or other harmful code, or probe or scan the Site for weaknesses without our written permission;
use the Site, or our rates and data, to build a competing product or service or to resell the data;
pretend to be us, or imply that we endorse you, your business or your products;
use the Site for anything unlawful, deceptive, defamatory or harmful, or in breach of anyone's rights; or
remove or alter any copyright, trademark or other notice on the Site.

If you want to use our data for a legitimate purpose, such as research, journalism or a partnership, please ask us. We are open to reasonable requests.

7. Intellectual property

The Site and everything on it, including the text, guides, articles, charts, tables, calculators, compiled data, design, layout, software, the name GoldRateToday and the logo, belong to Orion Appworks or its licensors and are protected by copyright, trademark and other laws in India and elsewhere. Except for the limited permission in section 5, these Terms give you no rights in them.

Quoting us. You may quote short extracts from the Site, such as today's rate or a sentence from a guide, if you clearly credit GoldRateToday and link to the page you took it from. You may not copy whole pages, or reproduce our rates or guides at scale.

Third-party material. Trademarks, names and logos of other companies and bodies that appear on the Site belong to their owners, and their use does not imply any association or endorsement.

8. Messages and feedback you send us

If you send us a message, report or suggestion, you confirm that what you send is lawful and does not infringe anyone's rights. You give Orion Appworks a free, worldwide and perpetual right to use any feedback or ideas you send us, without owing you anything, so that we can improve the Site. We will handle your personal information as described in our privacy policy.

9. Links to other websites

The Site may link to websites that are not ours. We do not control or endorse them and are not responsible for them. You use them at your own risk and under their own terms.

10. Accuracy, changes and availability

We try to keep the Site accurate and available, but we do not promise that it will be uninterrupted, error-free or free from delay. We may change, suspend or withdraw any part of the Site, including rates, tools and content, at any time and without notice. We may also change which cities and markets we cover.

11. No warranties

To the fullest extent the law allows, the Site is provided "as is" and "as available", without any promise or warranty of any kind, whether express or implied. This includes any warranty of accuracy, completeness, timeliness, fitness for a particular purpose, merchantability or non-infringement. We do not warrant that any rate, estimate or calculation is the price at which a transaction can be made.

12. Limitation of liability

To the fullest extent the law allows, Orion Appworks and its owners, directors, employees, partners and service providers will not be liable to you for any indirect, incidental, special or consequential loss, or for loss of money, profit, data, goodwill or opportunity, arising out of or in connection with your use of, or inability to use, the Site, or your reliance on anything on it, even if we were told such loss was possible. Where the law does not allow a liability to be excluded, our total liability to you for all claims relating to the Site will not exceed one thousand Indian rupees (₹1,000), since you pay nothing to use the Site. Nothing in these Terms limits liability that cannot be limited by law.

13. Indemnity

You agree to compensate and hold harmless Orion Appworks and its owners, directors, employees and partners against any claim, loss, liability, cost or expense, including reasonable legal fees, that arises from your breach of these Terms, your misuse of the Site, or your infringement of anyone's rights.

14. Suspension and ending

We may restrict, suspend or block your access to the Site at any time, without notice, if we believe you have broken these Terms, are putting the Site or others at risk, or if the law requires it. Sections that by their nature should continue after your access ends, including those on intellectual property, disclaimers, limitation of liability, indemnity and governing law, will continue to apply.

15. Notices and changes to the Terms

We may update these Terms from time to time, for example to reflect changes in the Site or in the law. We will change the date at the top of this page, and for significant changes we will take reasonable steps to tell you. If you keep using the Site after the new Terms take effect, you accept them. Please check this page from time to time.

16. Governing law and disputes

These Terms, and any dispute arising out of or in connection with them or the Site, are governed by the laws of India. We encourage you to contact us first so we can try to resolve any concern informally. If we cannot, the courts of competent jurisdiction in India will have jurisdiction over the dispute, subject to any mandatory rights you have as a consumer under applicable law.

17. General

Whole agreement. These Terms, together with the policies they refer to, are the entire agreement between you and us about the Site.
If part is unenforceable. If a court finds any part of these Terms invalid or unenforceable, the rest will continue to apply.
No waiver. If we do not enforce a right straight away, it does not mean we have given it up.
Assignment. You may not transfer your rights under these Terms. We may transfer ours to a successor of our business.
Language. These Terms are written in English, and the English version prevails over any translation.
